TERMS AND CONDITIONS

Tanya Beauty Care (“TBC”) is a specialist in providing the following services (the “Services”):

  • Cosmetic Tattooing (including Eyebrow feathering);
  • Skin Rejuvenation (which includes Dermapen, Exfowhite, Oxygen Gas Therapy, Age Protection, Dermabrasion & Facial);
  • Hair Removal (both Laser & Waxing); and
  • Lash and Brows Treatment (lash lift, lash and eyebrow tint).

We use state of the art technology and pride ourselves on our procedures & techniques, and are committed to delivering our high end Services to clients.

Term 1 – General

  1. By signing this agreement, you agree that you have read and understood these terms and conditions and agree to be bound by these terms.
  2. We reserve the right to amend, add or delete any or all of the terms and conditions at any time without any prior notice.
  3. If for any reason TBC is not capable of running the appointment as planned, whether caused by failure of equipment or information technology, line drop out, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of TBC which corrupt or affect the administration, security, fairness or integrity of TBC, TBC reserves the right in its sole discretion, (subject to any written direction given by relevant regulatory authorities), to cancel, terminate, modify or suspend the appointment subject to notice provided to clients.
  4. In the circumstance that the appointment cannot be held, we will reschedule (if we deem it is plausible) the appointment with you via telephone call, text message, email or other form of electronic communication, if we are unable to contact you via the methods provided.
  5. If any of these Terms and Conditions is determined to be unlawful, unenforceable or void, only the relevant term or condition, or the part of the term or condition, that is unenforceable will be excluded from these Terms and Conditions.
  6. Our failure to exercise any right under these Terms and Conditions does not constitute a waiver of that right or prevent the exercise of any other right.

Term 2 – Qualification for the Services

  1. You may not engage the Services if:
    • (a) you are under the age of majority (18 in Australia) in the place in which you are engaging and accessing the Services (including each and every jurisdiction in which you will access the Services);
    • (b) you have not completed the Client History Form; and
    • (c) you are pregnant and/or breastfeeding.
  2. We are not bound to provide, and we will not provide, the Services to you until sub-paragraphs 2.1 (a) – (b) above have been satisfied.
  3. You acknowledge and agree that the information provided on the Client History Form accurately describes and reflects your current health to the best of your knowledge.
  4. If we determine that the provision of the Services to you may not be suitable given the information you have provided on your Client History Form, we reserve our right to refuse our Services to you.

Term 3 – Consent

  1. You understand, agree and consent to the following regarding our Cosmetic Tattooing procedure:
    • (a) you will be courteous at all given times during our Services to staff members of TBC;
    • (b) the treatment is for cosmetic purposes only;
    • (c) you cannot donate blood for 6 months from the day of the procedure;
    • (d) you are aware that latex gloves are used by the Therapist;
    • (e) you have been provided with an aftercare sheet and home care package which outlines what is required after the procedure for maintenance and upkeeping, and you understand that failure to follow the aftercare sheet and use of our home care package may lead to infection or fading of pigments;
    • (f) we may use Topical Anaesthetics containing Lidocaine and Epinephrine;
    • (g) you are aware that you may require a follow up visit in 6-8 weeks from the date of the procedure, for the purpose of adjustments and/or touch-ups (Retouch-Up) and you are entitled to one complimentary retouch session (“Session”); and
    • (h) you consent to us taking a before and after photo of the Cosmetic Tattooing procedure that we may, from time to time, use on our social media page.

Term 4 – Non-Provision of the Services

  1.  We may refuse to provide the Services at any time if, for reasons other than those set out in Term 2, we in our sole discretion decide to do so. If we terminate the Services in these circumstances, the terms of Term 5 & Term 7 below will apply.

Term 5 – Refusal of an Order for the Services

  1. We, in our sole discretion and without having to provide a reason to you, may refuse any order to provide the Services to you.

Term 6 – Price and Payment

  • Our price list for each of our Services is listed on our Brochure/Website.
  • Acceptance is made of our Services upon payment for the quote provided by TBC.
  • TBC reserves its right to alter the Price of our Services as per condition 1.2 prior to acceptance.
    Cosmetic Tattooing procedure – Initial consultation fee
  • An initial deposit/consultation fee of $100.00 is required (non-refundable).
  • If you decide to proceed, TBC requires an additional $50.00 to be paid (non-refundable) to secure your appointment (in total, payment of $150.00 calculated as your initial deposit/consultation fee of $100.00 plus payment of $50.00). This amount will be deducted from the total fee for the Cosmetic Tattoo Procedure.
  • Upon completion of the Cosmetic Tattoo Procedure, the balance is required to be paid.
  • Payment can be made via Cash, EFT or via the EFTPOS machine on the premises.
    Skin rejuvenation, Hair Removal & Lash & Brows Treatment
  • Payment can be made via Cash, EFT or via the EFTPOS machine on the premises.

Term 7 – Refunds, Cancellations & Rescheduling

  • If after your initial deposit/consultation, you wish to cancel, your initial deposit/consultation fee is non-refundable.
  • TBC reserves its right, in its sole discretion, to have your initial deposit/consultation refunded. This is on a case to case basis and, in special circumstances, will this be refunded.
  • If you become aware that you are unable to attend your appointment and/or complimentary Session, you must inform us at least 48 hours prior to the appointment or Session. Failure to provide adequate notice (by email, call or text) will result in your deposit/consultation fee being forfeited and/or the loss of your complimentary Session.

Term 7 – Refunds, Cancellations & Rescheduling

  • If after your initial deposit/consultation, you wish to cancel, your initial deposit/consultation fee is non-refundable.
  • TBC reserves its right, in its sole discretion, to have your initial deposit/consultation refunded. This is on a case to case basis and, in special circumstances, will this be refunded.
  • If you become aware that you are unable to attend your appointment and/or complimentary Session, you must inform us at least 48 hours prior to the appointment or Session. Failure to provide adequate notice (by email, call or text) will result in your deposit/consultation fee being forfeited and/or the loss of your complimentary Session.Rescheduling your Complimentary Session
  • A surcharge fee of $150.00 is required to be paid upfront for rebooking your Session should you not inform us 48 hours prior of your appointment.
  • If you attend an appointment 20 minutes late from the designated appointment time, TBC may cancel the appointment and a surcharge to have this rebooked will apply in accordance with condition 7.4.
  • If an appointment and/or complimentary Session needs to be rescheduled by TBC, we will provide you notice as per condition 1.4. In this instance, TBC will provide clients the option for a refund if the time and date is not suitable to your schedule.
  • In the event that you are unable to attend your appointment, TBC will reschedule your appointment at a suitable date and time in accordance with the next available date on our calendar.
    Rescheduling your Complimentary Session
  • A surcharge fee of $150.00 is required to be paid upfront for rebooking your Session should you not inform us 48 hours prior of your appointment.
  • If you attend an appointment 20 minutes late from the designated appointment time, TBC may cancel the appointment and a surcharge to have this rebooked will apply in accordance with condition
  • If an appointment and/or complimentary Session needs to be rescheduled by TBC, we will provide you notice as per condition 1.4. In this instance, TBC will provide clients the option for a refund if the time and date is not suitable to your schedule.
  • In the event that you are unable to attend your appointment, TBC will reschedule your appointment at a suitable date and time in accordance with the next available date on our calendar.

Term 8 – Liability & Indemnity

  1. Our liability to you is limited to:
    • in the event that, in providing the Services to you, we breach any of the consumer guarantees set out in the Competition and Consumer Act 2010 (Cth) (“the Act”), and at our sole discretion, the supply of the Services again or the cost of having the Services supplied again; and
    • (b) in any other circumstance, and to the fullest extent permitted by law, and at our sole discretion, the supply of the Services again or the cost of having the Services supplied again.

Term 8 – Liability & Indemnity

  1. Our liability to you is limited to:
    • in the event that, in providing the Services to you, we breach any of the consumer guarantees set out in the Competition and Consumer Act 2010 (Cth) (“the Act”), and at our sole discretion, the supply of the Services again or the cost of having the Services supplied again; and
    • (b) in any other circumstance, and to the fullest extent permitted by law, and at our sole discretion, the supply of the Services again or the cost of having the Services supplied again.You acknowledge and agree that, to the fullest extent permitted by law:
    • (c) we will not be liable for, and you indemnify us against, any consequential loss or damage suffered by you or any other party as a direct or indirect result of us providing the Services to you; and
    • (d) nothing in these Terms and Conditions has the effect of contracting out of the Act.
  2. If you breach any of these terms, you indemnify us against all claims, liabilities, expenses (including legal fees on a solicitor-client basis) or losses that may be made against us or suffered by us arising from your breach of these Terms and Conditions.

Term 9 – Warranties & Guarantee

  1. Whilst every care is taken to ensure that the Services we provide are to the highest possible standards, we make NO guarantee or warranty of the results due to the nature of skin as it heals, and aftercare taken by clients.
  2. The Services are provided on an “as is” and “as available” basis with no express or implied warranty or conditions as to merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.

Term 10 – Copyright & Trademark

  1. The contents of these Terms and Conditions are protected by copyright. All rights are reserved.Copyright arises at the time that subject matter is reduced to a material form. There is no requirement for the copyright to be registered with a government agency for it to be protected, nor is it necessary to apply the © symbol to the work for it to be protected.We own and retain the copyright, trademarks and other intellectual property rights in the materials posted on our website including (but not limited to) watermarked photos, pictures and videos. Unless you are otherwise expressly authorised by us, you may only use this site for personal use. You may not sell or otherwise commercially exploit any information available on this site.If you submit material to us in connection with your use of any of our client’s social media, you thereby assign all intellectual property rights in that material to us. You must not submit material to our social media if a third party has any intellectual property rights in that material.
